TOP 6 Sonstiges

  • Hinweis zu TOP 4 aus Sitzung vom 05.09.2019: Der Europäische Datenschutzausschuss hat Anfang Juli 'Leitlinien zur Verarbeitung personenbezogener Daten durch Videoüberwachung' beschlossen und bittet bis Anfang September um Kommentare. Folgendes ist dazu eingereicht worden:

1. The limitation of anonymous movement and/or anonymous use of services is nothing less than a restriction of citizens fundamental rights and this should be mentioned in the text, e.g. as an addition to the last sentence: "Fundamental rights are seriously threatened and data protection implications are massive."
2. Video surveillance in public places and publicly accessible places like Malls should never be considered as 'in public interest'! Therefore Article 5 (1) (b) with its recital 50 should be limited.
8. The reasonable expectation of a person who recognizes a surveillance camera is, that she is being monitored, no matter if the camera is fake, broken, or fully working. Therefore fake cameras should always be treated like 'real' cameras, as the impact on citizens behavior is identical.
15. As mentioned above, we think that monitoring public and publicly accessible places by video surveillance should never be considered as 'in the public interest'. If mentioning Article 5 (1) (b), it’s Recital 50 should be limited.
16. We see no reason, why Article 6 (1) (e) "most likely" would be used as a legal basis for processing video surveillance data. We would recommend to restrict the use of this paragraph, as the surveillance of public spaces should never be considered in the public interest.
40. Same here, Article 6 (1) (e) should not be seen as a provision for the use of video surveillance in public spaces.
41. This paragraph should be erased completely, otherwise this opens the doors for the member states to again introduce their specific national legislation for video surveillance and many achievements of a common legal basis on data protection and respect for human rights will become obsolete.
110. Because of the much higher impact on fundamental rights and the risk for data subjects, the first layer information (warning sign) should be made easily recognizable, that a person is entering an area, where biometric processing and/or 'smart cameras' (with behavior recognition or other technics) are used. This could be achieved by using a different color for the sign, e.g. orange or red (instead of blue).
